Samsung and Apple are embroiled in worldwide litigation over the commercially important and growing tablet computer market. Across many jurisdictions, Apple is suing Samsung for infringement of Registered Designs. In order to take the fight to Apple and to expedite the matter, Samsung took the somewhat unusual step of seeking a declaration of non-infringement from the English courts. In response, Apple sought a stay of the non-infringement proceedings until conclusion of the notoriously slow invalidity proceedings were concluded (these proceedings were pending before the OHIM – the EU’s designs registry). In this article we review the procedural aspects of the case before the English courts.
